Re-examination of Hamesh Khan escape case demanded
Islamabad:The Pakistan Economy Watch (PEW) on Thursday demanded a re-probe into escape of Hamesh Khan, former President and CEO of Bank of Punjab from Peshawar Airport. It said that investigating agencies should stop playing with courts, disregarding law and promoting officials involved in serious cases.
Dr. Murtaza Mughal, President of PEW demanded of the Chief Justice Pakistan Muhammad Iftikhar Chaudhry to constitute a special investigation committee to review the matter and ensure justice. The name of Hamesh Khan was put on Exit Control List on 25th of April 2008 but he managed to fly out of the country from Peshawar Airport after that.
The then Advisor Interior suspended for officials on 20th July 2008. Five days later, an FIR No. 120/2008 was lodged against the accused. The accused secured bail and later managed to get the inquiry of the case transferred to Islamabad where they were eventually exonerated.
Later, said Dr. Murtaza Mughal, the said federal department put the case in the court of Judicial Magistrate VII Tariq Abbas to get relief for the charged officials. However, the magistrate raised serious observations on departmental findings and sent final report (challan) back for finalisation of probe on merit.
Dr. Murtaza Mughal said that the case was never submitted again in the court for trial in violation of the law as an investigation officer is bound to submit case in court within 15 days under section 173 Cr.P.C.
Insiders say that those interested in defending the accused were waiting for the transfer of judge to try anew for desired results. Tariq Abbas would never accommodate them as he is known as a person of unparalleled honesty, integrity and uprightness. It is interesting to note that one of the accused and an inquiry officer has been promoted while the main accused, the supervisory officer, got favorable recommendations from superiors.
Concerned officers were repeatedly contacted but they weren’t willing to give their side of story. Dr. Murtaza Mughal has asked CJP to take notice of issue and order investigations so that those playing with the legal system should be taken to task.- Pak Economy Watch
