Justice Raza terms steps after emergency as illegal

ISLAMABAD: The deposed judge of the Supreme Court Justice Raza Khan who refused to take oath under PCO has said that all steps taken by the government, after imposition of emergency in the country, were illegal and were far beyond contempt of court. In an interview with BBC, he said there are many offices lying vacant in the judges colony but the government allotted those houses to newly appointed judges which were already occupied by judges who didn’t take oath under PCO.

“We had decided in a meeting of the judges on May 21, 2007 that the retired judges can keep official residence for six months after their retirement. All the senior judges signed that decision. Now if the newly appointed judges make such a decision, I do not know they are asking us to vacate the residences.”When asked whether this step is contempt of court, he said contempt of court looks very minor thing and such acts are far above contempt of court.

Justice Raza said they were feeling themselves as prisoners of a country adding that the steps taken against them were not against judges but Pakistan itself. It is worth mentioning here that 12 Supreme Court Judges had not taken oath against PRCO. They included Chief Justice Iftikhar Muhammad Chaudhry, Justice Raza Khan, Justice Rana Bhagwandas, Justice Khalil Ramday and Justice Mian Shakirullah Jan.-SANA
